Preventative Counseling

Preventative guidance is one of the most important services Marc provides to his clients and is a key component to avoiding costly and time consuming litigation.  Marc regularly advises employers with respect to difficult employment issues, including:

  • Hiring, discipline and discharge of employees;
  • Responding to EEOC, Department of Labor and other administrative complaints;
  • Unemployment compensation matters;
  • Employment contracts and restrictive covenants (i.e. non-competition and non-solicitation agreements);
  • Wage and hour matters, including minimum wage, overtime issues and determining “exempt” or “non-exempt” status;
  • Commission issues;
  • Discrimination and harassment issues, including issues relating to investigating and appropriately addressing workplace discrimination and harassment;
  • Family and medical leave issues;
  • Disability issues;
  • Severance agreements;
  • EEOC investigations;
  • Department of Labor Investigations

It is also important that employees understand their workplace rights and obligations.  All too often, employees make the mistake of not seeking legal guidance from an experienced practitioner when confronted with issues that may give rise to liability to their employers.  Marc regularly advises employees with respect to a wide variety of employment issues, including:

  • Discrimination and wrongful discharge;
  • Wage and hour issues, including unpaid wages and entitlement to overtime compensation;
  • Unpaid commissions;
  • Employment Agreements;
  • Non-Compete, Non-Solicitation Agreements and other post-employment restrictions;
  • Confidential Information and Trade Secrets;
  • Severance Agreements;
  • Unemployment compensation.
